DUI with Serious Bodily Injury
DUI with serious bodily injury has an element of causing serious bodily injury to another person, directly or indirectly. This is a third degree felony and is punishable as follows:
- A minimum of 51 months in prison up to 5 years in prison;
- Up to 5 years of probation;
- Up to $5,000.00 in fines;
- Community service;
- Impoundment of vehicles;
- DUI School;
- Victim Impact Panel class;
- Driver’s license suspension;
- Substance abuse evaluation and treatment if necessary.
These penalties depend on how many prior an offender has, and if the BAC is above 0.15 or if a minor is present, then there is:
- A minimum of $1,000.00 in fines if it’s a first DUI offense;
- A minimum of $2,000.00 in fines if it’s a second DUI offense;
- A minimum of $4,000.00 in fines if it’s a third DUI offense;
- 6 months of ignition interlock device if it’s a first DUI offense; and
- 2 years of ignition interlock device if it’s a second or third DUI offense.
